International intended parents may consider a U.S. surrogacy journey because of clinic options, agency services, and legal pathways available in some jurisdictions. None of those pathways is uniform across the country.

Jurisdiction matters

Surrogacy law differs by state and can depend on residence, marital status, genetic connection, compensation, court procedure, and other case facts. California may offer established parentage procedures for some arrangements, but no state or court process should be described as seamless or universally available. Other states may impose different requirements or restrictions.

Cross-border questions

International intended parents should obtain advice from qualified professionals about:

  • The law governing the agreement and parentage procedure
  • Birth records, passports, citizenship, and travel documents
  • Immigration or consular requirements in the destination country
  • Clinic, insurance, escrow, tax, and payment rules
  • Translation and authenticated-document needs

An agency can coordinate introductions, schedules, records handoffs, and travel information authorized by the parties. It cannot provide immigration advice, determine citizenship, represent a party in court, or guarantee a parentage or travel outcome.

Before matching, each party should retain independent reproductive counsel, and international intended parents should consult qualified immigration or nationality counsel for the countries involved. Current written advice matters more than a historical blog post.
